1. Acceptance of Terms & Eligibility

By purchasing, downloading, or using the VPTrainer software application ("Software") or accessing the getvptrainer.com website ("Website"), you agree to be bound by these Terms of Use ("Terms"). These Terms constitute a legal agreement between you, the user, and Lumiscur LLC ("we", "us", or "our").

Eligibility: You must be at least 18 years of age (or the legal age to gamble in your jurisdiction, whichever is higher) to use this Software and Website. By using the Software, you represent and warrant that you meet this age requirement. If you do not agree to these Terms or meet the eligibility requirements, you may not use the Software or Website.

2. License Grant & Restrictions

Upon purchase, Lumiscur LLC grants you a limited, non-exclusive, non-transferable, and revocable license to use the Software for your personal, non-commercial use.

You agree NOT to:

• Modify, adapt, translate, reverse engineer, decompile, or disassemble the Software.
• Sell, distribute, rent, lease, or sub-license the Software or your license key to others.
• Attempt to bypass or dismantle the software's license verification mechanisms.
• Use the Software for any illegal purpose or in a manner inconsistent with these Terms.

3. Casino Usage & Legal Disclaimer (IMPORTANT)

VPTrainer is designed strictly for educational and training purposes.

YOU ARE EXPLICITLY PROHIBITED FROM USING VPTRAINER DURING ACTIVE PLAY ON A CASINO FLOOR. The use of electronic strategy tools or calculation devices while actively gambling is illegal in many jurisdictions, including Nevada.

By using this Software, you agree that you are solely responsible for ensuring that your use of the Software complies with the laws and regulations of your local jurisdiction and the rules of any specific casino establishment. Lumiscur LLC assumes zero liability for any legal consequences, bans, or penalties incurred by your use of the Software in a restricted environment.

4. Limitation of Liability

The strategies, expected value (EV) calculations, and training feedback provided by VPTrainer are based on mathematical probabilities derived from standard video poker paytables.

Gambling involves inherent risk. VPTrainer does not guarantee you will win money. Video poker remains a game of chance, and short-term variance can lead to significant financial loss even when playing mathematically perfect strategy.

IN NO EVENT SHALL LUMISCUR LLC, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, FINANCIAL LOSSES, GAMBLING DEBTS, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SOFTWARE. YOU GAMBLE AT YOUR OWN RISK.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SOFTWARE OR WEBSITE EXCEED THE TOTAL AMOUNT YOU PAID TO LUMISCUR LLC FOR THE SOFTWARE.

5. Disclaimer of Warranties

THE SOFTWARE AND WEBSITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT THE MATHEMATICAL CALCULATIONS AND STRATEGY RECOMMENDATIONS ARE 100% ACCURATE AT ALL TIMES.

6. Indemnification

You agree to indemnify, defend, and hold harmless Lumiscur LLC, its affiliates, and its respective officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Software or Website; (b) your violation of any term of these Terms; or (c) your misuse of the Software in a restricted operational environment (such as an active casino floor).

7. Refunds & Chargebacks

We stand behind our product. We offer a 14-Day Money-Back Guarantee. If you are not satisfied with VPTrainer, you may request a full refund within 14 days of your original purchase date.

Refunds are processed through our Merchant of Record, Lemon Squeezy. Upon issuance of a refund, your license key will be permanently deactivated and you must delete the software from your devices. To request a refund, please contact support.

Chargebacks & Payment Disputes:

If you initiate a chargeback or payment dispute with your credit card company or bank for a valid transaction, your license key will be immediately and permanently revoked. We reserve the right to vigorously contest chargebacks by providing our Merchant of Record and the relevant financial institution with evidence of software delivery and license activation. You agree to be liable for any dispute fees or operational costs incurred by Lumiscur LLC as a result of a fraudulent or invalid chargeback.

8. Intellectual Property

The Software, Website, and all content therein (including algorithms, graphics, text, and user interfaces) are the exclusive intellectual property of Lumiscur LLC and are protected by applicable copyright and trademark laws.

9. Termination & Survival

We reserve the right to terminate your license and access to the Software at any time, without notice, if you breach these Terms (including, but not limited to, sharing your license key or attempting to pirate the software).

Survival: All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law, Jurisdiction & Class Action Waiver

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or the Software shall be brought exclusively in the state or federal courts located in Wyoming, and you hereby consent to the personal jurisdiction and venue therein.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

11. Informal Dispute Resolution

We want to address your concerns without needing a formal legal case. Before filing a claim against Lumiscur LLC, you agree to try to resolve the dispute informally by contacting us directly at support@getvptrainer.com. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you or Lumiscur LLC may bring a formal proceeding.

12. Severability & Entire Agreement

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and Lumiscur LLC regarding our Software and Website, and supersede and replace any prior agreements we might have had between us regarding the Software.

13. Changes to Terms

We may update these Terms from time to time. The most current version will always be available on our Website. Your continued use of the Software or Website after any changes constitutes your acceptance of the new Terms.
